Macomb Marine Parts and Accessories LLC: Terms of Sale & Return Policy

By purchasing from Macomb Marine Parts and Accessories LLC ("Macomb"), the Buyer agrees to the following terms and conditions. These policies are in place to ensure the availability of high-quality, uncompromised marine components.

1. Notice of Claims: Shortages & Damages

The Buyer is responsible for inspecting all packages immediately upon delivery.

  • Time Limit: All claims for shortages, inaccuracies, or shipping damages must be submitted in writing to Macomb within forty-eight (48) hours of the delivery timestamp provided by the carrier.
  • Failure to Notify: Failure to provide written notice within this window constitutes an irrevocable acceptance of the goods and an admission that they fully comply with the terms, conditions, and quantities of the invoice.
  • Documentation: Claims for damage must include photographic evidence of the external packaging and the damaged contents.

2. Return Merchandise Authorization (RMA)

No returns will be accepted without a valid Return Merchandise Authorization (RMA) number.

  • Request Process: To request an RMA, the Buyer must email Macomb with the original order number, the item(s) in question, and a detailed reason for the return.
  • Unauthorized Returns: Any packages sent to Macomb without a visible RMA number on the exterior of the shipping box will be refused and returned to the sender at the sender’s expense.
  • Expiration: RMAs are valid for fourteen (14) calendar days from the date of issuance. If the merchandise is not received within this window, the RMA is voided and the return will be denied.

3. Restocking Fees & Credit Reductions

All eligible returns are subject to a restocking fee based on the time elapsed from the original invoice date:

  • 0–30 Days: 15% Restocking Fee
  • 31–60 Days: 25% Restocking Fee
  • 61+ Days: No returns or credits permitted.

Additional Deductions:

  • Original Shipping Costs: Shipping and handling charges are non-refundable.
  • Free Freight Recovery: If the original order qualified for "Free Shipping," the actual freight costs incurred by Macomb to ship the order will be deducted from the final credit.

4. Order Cancellations

Our fulfillment system is designed for speed.

  • Cancellation Fee: A 15% cancellation fee applies to any order cancelled by the Buyer prior to the estimated delivery date posted on the product page.
  • Urgency Disclaimer: It is the Buyer's responsibility to select the appropriate shipping speed. Cancellations due to "parts not arriving fast enough" are still subject to the 15% fee if the order is within the posted lead-time window.

5. Shipping Responsibilities & Risk of Loss

  • Return Shipping: The Buyer is responsible for all return shipping costs and assumes the risk of loss or damage during transit. We strongly recommend using a trackable service and purchasing shipping insurance.
  • Merchant Error: Macomb will provide a Ground Service return label only in cases of verifiable Merchant error (e.g., shipping the wrong part number).
  • Warranty Exclusions: Warranty claims for defective parts are handled per the manufacturer’s policy and do not constitute a "Merchant error" regarding shipping costs.

6. Condition Requirements

To qualify for a refund, items must be in pristine, sellable condition.

  • Packaging: Parts must be in the original, unopened, and undamaged manufacturer packaging.
  • Repackaging Fees: If the original packaging is marked, taped, or slightly damaged but the item is still sellable, a 15–25% repackaging fee will be applied at the sole discretion of Macomb.
  • Denial of Credit: If a part shows signs of installation, use, "testing," or tool marks, credit will be denied entirely, and the part will be returned to the Buyer at their expense.

7. Non-Returnable Items (Strict Policy)

To protect our inventory integrity, the following items are strictly non-returnable and non-refundable:

  • Electrical Components: All electrical parts (Staters, ECUs, Power Packs, Solenoids, etc.).
  • Fuel System Components: Any part that has been in contact with fuel or contains fuel residues.
  • Engine Internals: Cylinder heads, intakes, carburetors, and fuel pumps.
  • Cut-to-Length Goods: Custom-cut wires, hoses, or tubing.
  • Special Orders: Any items not typically stocked or marked as "Special Order."
  • Installed/Altered Items: Any product that has been bolted on, wired, or modified.
  • Propellers: All propellers (excluding specific Piranha brand exceptions provided in writing).
  • Generators: All generators and installation kits.
  • Lower or Upper Units, or Complete Sterndrives: any warranty or replacement is solely at the Manufacturers discretion.

8. Disclaimer of Labor & Consequential Damages

Macomb Marine Parts and Accessories LLC acts solely as a supplier of marine parts.

  • No Labor Reimbursement: Under no circumstances will Macomb be liable for labor costs, shop fees, towing charges, or storage fees associated with the installation, removal, or failure of any part purchased.
  • Fitment Responsibility: While we may provide cross-reference information, the Buyer is ultimately responsible for verifying fitment with their mechanic or via the manufacturer’s parts catalog prior to purchase.


WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

1. Manufacturer Warranties Only

All products sold by Macomb Marine Parts and Accessories LLC ("MacombMarineParts.com") are distributed as-is from original equipment manufacturers (OEM) and aftermarket manufacturers. All products are subject solely to the warranties, if any, provided by the respective manufacturer.

Macomb Marine Parts and Accessories LLC acts strictly as a reseller and does not provide any independent warranty for any products sold. The manufacturer retains sole and absolute discretion regarding the verification, processing, and final determination of any warranty claims.

2. Disclaimer of Implied Warranties

To the maximum extent permitted by applicable law, Macomb Marine Parts and Accessories LLC hereby expressly disclaims all warranties, either express or implied, including but not limited to:

  • Any implied warranty of merchantability.
  • Any implied warranty of fitness for a particular purpose.
  • Any warranty against infringement of intellectual property rights of a third party.

The Company neither assumes nor authorizes any person or representative to assume for it any liability in connection with the sale of these products.

3. Exclusion of Labor and Consequential Damages

Under no circumstances shall Macomb Marine Parts and Accessories LLC be liable for any indirect, incidental, special, or consequential damages. This exclusion specifically includes, but is not limited to:

  • Labor Charges: The Company shall not be responsible for costs associated with the installation, removal, or repair of any parts or equipment.
  • Operational Loss: The Company is not liable for loss of use, towing fees, storage fees, dockage fees, or lost profits.
  • Property Damage: The Company is not liable for damage to other components caused by the failure of a purchased part.

4. Warranty Claim Assistance

While Macomb Marine Parts and Accessories LLC plays no role in the adjudication of warranty claims, we are committed to facilitating a smooth process for our customers. Upon request, the Company will:

  • Provide copies of manufacturer warranty documentation when available.
  • Direct customers to the appropriate manufacturer contact for claim submission.
  • Assist with providing proof of purchase required for warranty validation.

5. Acceptance of Terms

By purchasing products from MacombMarineParts.com, the customer acknowledges that they have read, understood, and agreed to be bound by this Warranty Disclaimer.

6. Policy Modifications

Macomb Marine Parts and Accessories LLC reserves the right to modify, amend, or update this policy at any time without prior notice. The version of the policy in effect at the time of purchase shall govern the transaction.
